Enhanced Penalty Blood-Alcohol Concentration in California

California has no separate punishment for driving with a heighten blood alcohol content. Rather, if the motorist is convicted of driving under the influence of alcohol, the court may consider a concentration of alcohol in the person’s blood of 0.15 blood alcohol content or higher as a special factor that may justify enhancing the penalties in sentencing, in determining whether to grant probation, and, if probation is granted, in determining additional or enhanced terms and conditions of probation.

For example, if the motorist is convicted of driving under the influence, the judge can imprison the motorist or place her on probation. If the motorist is given probation, she may be required to random testing or an ignition interlock device. Higher blood alcohol content gives the judge discretion on what kind of punishment should be given.
