Prescription Drugs and DUI in Florida
The law in the state of Florida recognizes DUI impairment when an individual is impaired by a prescription drug in his or her system. This is because prescription drugs can have the same detrimental effect on an individual’s motor skills as alcohol does when used in excess or improperly. Many prescription drugs will lead to an individual performing poorly on a field sobriety test if not used correctly. In the individual’s court case, it is helpful to have expert testimony concerning the correct dosage and use of the prescription medication for that individual. There is not a threshold of impairment for prescription drugs cases as there is for alcohol (0.08%). It is up to the officer to determine whether the individual is impaired to the point of being a driving hazard to himself or herself and/or others.
