Underage Drunk Driving in Hawaii

Hawaii has different charges for a driver who is under the age of 21 and is convicted of operating a vehicle under the influence of an intoxicant. Since the driver is under the legal drinking age, the person does not need to have a BAC above .08 to be convicted of an OVII. A person under the age of 21 will be arrested if the officer believes the driver has a measurable amount of alcohol in their system. A person under the age of 21 who operates a vehicle with a measurable amount of alcohol will be arrested if the officer has probable cause to believe the accused is under 21 and was operating a vehicle on a public roadway with a measureable amount of alcohol. The court will impose:

  • A requirement that the accused attend an alcohol abuse education and counseling program for at most 10 hours
    • if the accused is under the age of 18, their parents or guardians must attend with them
  • 180 day prompt suspension of license and privilege to operate a vehicle with absolute prohibition from operating a vehicle during the suspension period
    • if the accused is under 18, the court may impose instead at least a 30 day suspension of license with absolute prohibition from operating a vehicle and for the remainder of the 180 day period a restriction on the license that allows the person to drive for limited work-related purposes and to participate in alcohol abuse education and treatment programs

The court could also sentence the accused to community service for up to 36 hours or a fine between $150 and $500.

If the person is under 21 years old and refuses to take a test on site after an officer stops them, the officer shall submit an affidavit stating the officer had probable cause to believe the person was under the age of 21 and operating a vehicle with alcohol in their system, the arrested person was informed that the person may refuse to submit a test, the person had refused to submit a test.
