Enhanced Penalty Blood-Alcohol Concentration in Idaho

If an individual is found to have a BAC of .2 or higher, the penalties that they will receive increase. This does not mean that both DUI’s need to be in Idaho. Even a DUI in another state will count for these increased penalties. The potential penalties include:

(1) A jail term of at least 10 days but not more than one year

(2) Fined no more than $2,000.00

(3) Receive a suspended license for one full year after their release from jail.

If this is the second DUI with a BAC over .2 in the last 5 years then the penalties are heavier still.

(1) The defendant will receive a sentence between 30 days and 5 years.

(2) The defendant will receive a fine no larger than $5,000.00

(3) The defendant will get their license suspended for 1 to 5 years.

(4) The defendant’s car will have to be fitted with an interlocking system.
