Because of their responsibility for public safety, commercial drivers are subjected to lower blood alcohol content limits. If a person has been arrested for driving impaired while holding a commercial drivers license, he/she is also at risk for greater punishments than just an ordinary DUI arrest. The penalties are higher and the arrest alone could lead to immediate dismissal by the person’s employer. The offender will also have difficulty securing transportation-related employment.

In addition to any applicable penalties that would occur if the driver was not driving a commercial vehicle, if the offender holds a commercial driver license, he/she will be barred from driving a commercial vehicle for one year if he/she is convicted for a BAC higher than 0.04%. The offender will be barred from driving a commercial vehicle for at least three years if he/she is convicted for a BAC higher than 0.04% while transporting hazardous materials. If the offender is convicted for a second offense, he/she will be barred from driving a commercial vehicle for life. If the driver refuses the breath test, his/her license will automatically be revoked for life.
