The BAC threshold for DUI for a commercial vehicle is .04%, which is lower than the non-commercial vehicle threshold of .08%.  The same penalties imposed on drivers over 21 apply, but in addition, license suspensions are longer.

(1)    First Conviction:  A first DUI conviction while operating a commercial vehicle will result in a one year license suspension.   A refusal to take a breath test will also result in a one year license suspension.  Conviction of DUI while transporting hazardous materials will result in a three year license suspension.

(2)    Second Conviction:  A second DUI conviction while operating a commercial vehicle will result in a life-time license suspension.  A refusal to take a breath test will also result in a life-time license suspension.
