Administrative Review Hearings in Missouri

Administrative Hearings are conducted at the Circuit Court by the Director of Revenue shortly after the DWI arrest.  This is a hearing for a driver to receive their license back after it was taken from after their arrest.  A person has 15 days to request a hearing after their arrest or else the suspension of license will automatically take into effect.   At the hearing, the judge will consider whether or not the defendant was lawfully stopped, whether or not there were reasonable grounds for the chemical test, and whether the defendant refused to submit to the chemical test.  Whatever the result of an administrative hearing, a defendant can always try to appeal the decision and petition for a trial de novo to the Circuit Court.
