Commercial License and DUI (DWI) in Missouri
The DWI/BAC law differs slightly for commercial motor vehicles. Commercial motor vehicles include vehicles that are single vehicles with a gross vehicle weight rating of 26,000 pounds or more, trailers with a gross vehicle weight rating of 10,000 pounds or a gross combination weight or 10,000 pounds, a vehicle that can transport more than 15 people, or a vehicle that transports hazardous materials.
A DWI for a commercial vehicle differs in that the illegal BAC legal is not .08, but is the lower BAC level of .04. Any commercial motor vehicle driving and has a BAC of .04 or greater is in violation of driving with driving while intoxicated. A commercial motor vehicle operator can be arrested for a lower BAC level than the normal motor vehicle driver due the fact that driving a commercial motor vehicle is believed to be of a more dangerous and riskier nature than that of a standard motor vehicle. A commercial motor vehicle operator will face a penalty of losing their commercial drivers license for a minimum of one year.
