Prescription Drugs and DUI (DWI) in Missouri

The driving while intoxicated statute provides that a person can be found guilty of a DWI while in an intoxicated or a “drugged condition.”  This is not simply limited to illegal drugs like heroin and cocaine but also includes prescription drugs and could even include over-the-counter drugs if it made  a person in drugged condition and dangerous to operate a motor vehicle.  This is because many prescription drugs, especially if they are used in combination with others or in high does can have results that are similar to illegal drugs.  Additionally, many prescription drugs can produce bad side effects.  For instance, some prescriptions medications can impair people by making them drowsy, or sleepy.  Sometimes medications can also affect ones vision and coordination as well.
