Underage DUI in Oklahoma

Oklahoma has enacted the “Drunk Driving Prevention Act.” This statute focuses specifically on underage driving under the influence. Under the Drunk Driving Prevention Act, it is unlawful for anyone under the age of 21 to be driving under the influence. Unlike adults, there is no defined blood alcohol content. The test is whether the minor has any “measurable quantity” in her blood or breath. Thus, having anything other than a 0.00 BAC is sufficient for underage DUI. Accordingly, the implied consent law is also in effect; the minors might be forced to give their breath, urine, or blood sample if requested.

If convicted for a first offense, the following punishment applies:

  • A fine not less than $100.00 but not more than $500.00;
  • 20 hours community service
  • complete a treatment program
  • cancellation or denial of driving privileges
  • mandatory revocation of driving privileges

If convicted for a second offense, the following punishment applies:

  • A fine not less than $100.00 but not more than $1000.00
  • 240 hours of community service
  • complete a treatment program
  • installation of an ignition interlock device for more than 30 days
  • cancellation or denial of driving privileges for two years or when the minor attains eighteen (18) years of age, whichever is longer
  • mandatory revocation of driving privileges and
  • any court recommended treatments

If convicted for a third or subsequent offense, the following punishment applies:

  • A fine not less than $100.00 but not more than $2000.00
  • 480 hours of community service
  • complete a treatment program
  • installation of an ignition interlock device for more than 30 days
  • cancellation or denial of driving privileges for two years or when the minor attains eighteen (18) years of age, whichever is longer
  • mandatory revocation of driving privileges and
  • any court recommended treatments
