If you are found guilty and this is your first offense, you can be convicted of a felony or misdemeanor. As punishment,

  1. the court shall:
    1. Impose a jail sentence of not less than 48 consecutive hours
    2. Require the person to participate in a compensatory-service work program for not less than 48 hours; or
    3. Require the person to participate in home confinement
  2. Order the defendant for screening
  3. Order the defendant to participate in an assessment
  4. Order the defendant to participate in an educational program (i.e. Alcohol Anonymous)
  5. Impose a fine of $700 or more
  6. Order probation
  7. The court may:
    1. Order the defendant to participate in a substance abuse program

If you are convicted of two or more DUI within 10 years of your previous DUI conviction, you can be convicted of a misdemeanor or felony. As punishment,

  1. the court shall:
    1. Impose a jail sentence of not less than 240 consecutive hours
    2. Require the person to participate in a compensatory-service work program for not less than 240 hours; or
    3. Require the person to participate in home confinement
  2. Order the defendant for screening
  3. Order the defendant to participate in an assessment
  4. Order the defendant to participate in an educational program (i.e. Alcohol Anonymous)
  5. Impose a fine of $800 or more
  6. Order probation
  7. The court may:

Under Utah law, whether a DUI is a felony or misdemeanor depends on how the prosecutor charges it. If the prosecutor decides to prosecute you for a felony, an infinite imprisonment might be given. The court, however, can set aside the imprisonment and place you on probation with the following conditions:

  1. That you pay a $1500 fine
  2. That you be sentenced to 1,500 hours jail sentence
  3. That you participate in supervise probation
  4. And that you participate in a substance abuse program.
