DUI Penalties in D.C.

For all drunk driving offenses or for driving under the influence of drugs, the driver will be assessed 12 points on his/her license. In addition, the driver’s license will automatically be suspended for 90 days after arrest.

For the first DWI/DUI offense, the penalty is a fine of $300 and up to 90 days in jail. If the BAC is at least 0.20% but not more than 0.25%, the mandatory minimum sentence is five days. If the level is more than 0.25% by weight of alcohol, the mandatory minimum sentence is 10 days. In either instance, the driver license will be suspended for 6 months upon conviction.

If the second offense occurs within 15 years of the first one, then the fine will be at least $1,000 but no more than $5,000. There is a mandatory jail sentence of at least five days but no more than a year. Typically, a higher BAC will increase the minimum jail sentence. Furthermore, 30 days of community service is required and the driver’s license will be suspended for a year.

Upon the third or subsequent offense that occurs within 15 years of the second offense, the fine increases to at least $2,000 but no more than $10,000. The driver will serve a mandatory prison sentence of at least 10 days but no more than a year. In addition, the driver must complete 60 days of community service and his/her license will be revoked for two years.

The penalties for OWI only slightly differ from DWI/DUI. For a first offense, the penalty is a fine of at least $200 but no more than $300 and up to 30 days in jail. For a second offense which occurs within 15 years of the first, the penalty is affine of at least $300 but no more than $500 and up to thirty days in jail, five days of which are a mandatory minimum. For a third offense within 15 years of the second, the penalty is a fine between $1000 and $5,000 and either a jail sentence of between ten days and one year or sixty days of community service.
